This law emphasizes the concepts of public officials and public funds, reflecting the size of the public sector and Kuwait’s economic structure, which relies heavily on a single primary source of income.
The law imposes strict criminal liability on public officials who harm public funds, covering offenses ranging from embezzlement, misappropriation, profiteering, and intentional damage, to the disclosure of government secrets, as well as unintentional harm to public funds resulting from errors committed by public officials during the course of their duties. These offenses are not limited to traditional public officials but also extend to certain categories of private sector employees and some companies and institutions whose funds are legally treated as public funds.
